Provisional patent application.

Organise invention disclosures and coordinate a provisional specification with a patent professional.

Scope before commitment Requirements explained
01 / THE BIG PICTURE

The right support.
With the details in view.

Capture an invention in a provisional specification while development continues. We organise the disclosure and coordinate drafting and filing with a patent professional, paying attention to what is actually described. A provisional filing is not a granted patent and requires a complete specification within the applicable statutory period.

First, establish what applies

Search, application, examination and grant or registration are different stages. Assess ownership, prior rights, classes and evidence with the relevant IP professional; an application does not guarantee protection.

What the scoped work can cover

  • Prepared provisional specification within the agreed scope
  • Application filing record and reference
  • Complete-specification preparation and deadline checklist
02 / GET READY

The documents.
A clearer starting point.

Use this as a preparation list for the initial review. The final checklist is confirmed against the applicant, service route, location and current authority requirements.

  1. 01

Detailed invention disclosure and technical drawings

  2. 02

Inventor and applicant identity, address and nationality details

  3. 03

Employment, assignment or other entitlement records

  4. 04

Known prior art and public disclosure history

  5. 05

    Applicant category evidence where relevant

  6. 06

Agent authorisation where a representative files

Share sensitive records only through an agreed secure channel after the engagement is confirmed. Do not send passwords, OTPs or signing keys.

03 / HOW IT MOVES FORWARD

One step.
Then the next.

A clear sequence, with room to resolve the details that are specific to your business.

  1. 01

    Review readiness

Assess the invention, ownership and disclosure history to decide whether provisional filing is suitable.

  2. 02

    Draft the specification

Coordinate a technically meaningful description and necessary drawings with the patent professional.

  3. 03

    Approve and file

Confirm applicant and inventor details, authorisations and the final filing package.

  4. 04

    Plan completion

Record the priority information and set a clear development and complete-specification timetable.

Scope, fees and timing are agreed after review. Document readiness, professional review and any authority queries affect the schedule. Statutory charges, testing, execution and other third-party costs are identified where relevant.

04 / BEYOND THIS STEP

Keep the next
responsibility in view.

Continue development records, protect confidentiality and begin complete-specification drafting well before the relevant deadline.

05 / A LITTLE MORE CLARITY

Good questions.
Useful answers.

01Does a provisional filing give a granted patent?+

No. It is an application stage and does not itself create an enforceable granted patent.

02When must the complete specification follow?+

For the ordinary Indian provisional route, section 9 requires a complete specification within twelve months of filing. The exact case and priority strategy should be reviewed with the patent professional.

03Will later improvements get the original priority date?+

Not automatically. Priority depends on what the earlier disclosure adequately supports, and new subject matter needs careful assessment.
